This article is a study of the role and use of evidence in the evaluation of claims in the historical sciences. In order to do this, I develop a “snapshot” approach to Toulmin schemas. This framework is applied to the case of Archezoa, an initially supported then eventually rejected hypothesis in evolutionary biology. From this case study, I criticize Cleland’s “smoking gun” account of the methodology of the historical sciences. I argue that Toulmin schemas are conceptually precise tools that allow (...) for the building of enriched reconstructions of evidential reasoning. From the application of this framework, I discuss three ways in which the construction and use of facts in the historical sciences are theory-laden. Despite its inherent limits, TS are heuristically useful tools to identify epistemic moves that could be further investigated. It also sheds light on the positive roles of speculation in the historical sciences. Finally, I argue that it provides a context-specific and individuated understanding of hypothesis evaluation in the historical sciences. Overall, I think the application of Toulmin schemas to cases of evidential reasoning in the historical sciences is a promising descriptive and heuristic tool for philosophers of science. (shrink)

Nous montrons (...) que l’analyse phylogénétique n’est pas une expérimentation, et donc n’appartient pas au « style de laboratoire », tel que défini par Hacking. Elle ne correspond pas non plus à une méthode typique des sciences historiques, telle que décrite par Cleland. Bien que la correspondance de l’analyse phylogénétique avec ces catégorisations ne soit que partielle, nous défendons l’utilité de chacune de ces confrontations pour souligner des aspects distincts de cette pratique. Resumen Este trabajo tiene dos objetivos. Desde el punto de vista conceptual, nos proponemos contribuir al conocimiento del concepto de voz y su construcción conversacional a partir de la (des)afiliación y el (des)alineamiento en el proceso de validación o rechazo de la voz de los participantes. Desde el punto de vista práctico, esperamos contribuir al desarrollo de los métodos de la investigación participativa, entendidos en ciencias sociales como una metodología de investigación y aprendizaje colectivo, a partir del análisis crítico de (...) un caso. Para ello, adoptamos sobre el análisis de la interacción verbal un punto de vista discursivo que nos permite definir el concepto de voz como un conjunto de regularidades semióticas que indexicalizan una trayectoria biográfica a través de los discursos sociales que la componen. De este modo, la voz individual es producto de la trayectoria social -y discursiva- del hablante, la cual, al recibir validación o rechazo de los demás participantes, se pone a prueba en cada interacción. En ese sentido, proponemos que la (des)afiliación y el (des)alineamiento conversacionales permiten validar o rechazar las dimensiones de voz propuestas por el hablante. Exploraremos esta hipótesis en un corpus de reuniones de un proyecto de investigación participativa desarrollado en Buenos Aires, Argentina, con la participación de investigadoras e investigadores académicos y dirigentes sindicales, deteniéndonos especialmente en el caso de una de las participantes, que abandonó el proyecto al poco tiempo de comenzar. The “lost generation,” or the generation of the cultural revolution, is unique in world history: it is the result of the demiurgical will of one man, Mao Zedong, to create a whole generation “revolutionary successors” entirely devoted to the cause of socialism and to the realization of Maoist ideals. Even though Mao’s endeavor ended in complete failure, the mark it left on the young people who experienced it was deep enough to form a very specific and particularly self-conscious generation. Awareness (...) of being part of a certain generation is not limited this particular group and is more widespread in China than in most countries. Articles and books on generational phenomena are also particularly numerous in China, and the subject is frequently dealt with among observers and scholars outside the People’s Republic. But the criteria used to define different generations are not always clear and well founded. Moreover, the definition of the concept of generation itself is disputed and many social scientists, especially in the United States, reject its use outside the realm of kinship. We feel, therefore, obliged to clarify first what we mean by this concept and why it can be useful. This should help us answer our main questions: How do we define the “generation of the Cultural Revolution”? What is its role today’s Chinese politics and what could it be in the near future? Philosophers have usually highlighted how the weakness and paucity of historical evidence underdetermine the choice between rival historical explanations. Focusing underdetermination on the link between theory and evidence comes, I argue, with three assumptions: competing hypotheses are easy to generate, investigators agree on the constitution and interpretation of the evidence and a plurality of hypotheses is a useful evil to reach consensus. The last assumption implies that the sustained coexistence of incompatible hypotheses is considered as a scientific failure. I argue (...) that this negative vision of sustained disagreement has monistic undertones. By drawing from a case study in evolutionary biology, this paper defends a form of scientific pluralism. Firstly, I show that underdetermination is not only found at the inferential level but also at the level of the constitution and interpretation of the evidence, on the choice of investigative scaffolds and when interpreting background theories. Because of that, competing hypotheses exhibit a degree of methodological incommensurability. While catastrophic from a monistic standpoint, I defend that scientific pluralism gives a different, and I think richer, account of such situations. On the plus side, competing approaches benefit from their sustained coexistence and interaction. I argue that this generates direct and indirect epistemic goods independently of whether the controversy is solved. Scientific pluralism also shifts our attention from achieving consensus to managing disagreement. The challenge becomes to maintain the conditions for fruitful interactions in a community with incommensurable approaches and heterogeneous expertise. (shrink)

In this paper I want to do the following things. First I want to show that in the part of the Theaetetus where the relationship between knowledge and perception is examined, the concept of knowledge that is in question is very clearly characterized. We are left in no doubt as to what is to count as knowing. Secondly I want to unravel in some detail the case that Socrates puts on Protagoras’ behalf where he draws on what Protagoras actually wrote (...) (151 E-152C); as opposed to what he may have taught secretly to his pupils (152C-160D). Thirdly I wish to argue that if we let the dialogue speak for itself, it is manifest that this case put up on Protagoras’ behalf at 151 E-152C is not overthrown; it is not even shaken. (shrink)

El objetivo del artículo es presentar el diseño y la evaluación de un taller de prevención y sensibilización contra el acoso sexual. En total 286 estudiantes (224 mujeres y 62 hombres) de distintos grados de la Universidad de las Islas Baleares participaron en el taller y mostraron una alta satisfacción con el taller. 197 participantes incluso dieron la máxima puntuación en todos los 9 ítems del cuestionario de evaluación. Estos resultados animan a impulsar su aplicación en otros estudios y también (...) dentro del marco de formación del personal docente e investigador (PDI) y del personal de administración y servicios (PAS). This article analyzes doctor–patient communication at admission interviews in an outpatient mental health care service at a public hospital in Buenos Aires, Argentina. These interviews are the first contact between professionals and patients, and they result in the admission or rejection of the latter into the medical institution. In particular, we observe how context, understood as a sociocognitive and scalar concept, is reshaped with gaze direction and agenda-setting through interaction, resulting in three hierarchical spaces which can be represented as degrees (...) in a scale: the public, the private, and the intimate level. This description will allow us to understand a series of communicative difficulties that may result from scale maladjustments, in which professionals interact with patients at different levels and therefore cannot give adequate feedback to satisfy mental health care needs. Lejos de avanzar hacia el ideal emancipador que representa, en la época del neoliberalismo globalizado la democracia es un instrumento de dominación al servicio de una regulación social excluyente y desigual que origina nuevas formas de autoritarismo.

The aim of this paper is twofold. On the one hand, it tries to analyze and sistematize some of the concepts used when approaching the linguislic problems concerning the legal documentation automatic systems: legal language, documentary language, linguistic coordination (a priori and a posteriori) and thesaurus. On the other hand, it intends to carry out a detailed study of the legal thesauri, focusingbasicany on its t wo structural elements: the vocabulary and the paradigmatic relationships.

Because anticipated and retrospective regret play important roles in practical deliberation and motivation, better understanding them can illuminate the contours of human agency. However, the possibility of self-ignorance and the fact that we change over time can make regret—especially anticipatory regret—not only a poor predictor of where the agent will be in the future but also an unreliable indicator of where the agent stands. Granting these, this paper examines the way in which prospective and, particularly, retrospective regret can nevertheless yield (...) important insight into the sorts of creatures we are, both generally and individually. The experience of retrospective regret can show a person she values something in a way she did not know or that she is (or was) a different person than she had thought, insights which can factor into forward-looking, or prospective, deliberation. Such instances of revelatory regret reveal something to the agent about herself as agent. I examine two cases of agential self-ignorance. In the first, the experience of regret reveals what the agent values, not only to others but even to the agent himself. In the second, the agent anticipates experiencing regret for an action but does not experience the regret, suggesting that the agent did not value the rejected alternative in the way she thought. Anticipatory regret is forward-looking and can play an important role in practical deliberation. But insofar as anticipatory regret flows from one’s imperfect judgment and prospection about oneself, retrospective regret can be an important corrective in helping the agent understand her own standpoint. My discussion addresses the differences between analytic and continental philosophy concerning the use of logic and exact reasoning in philosophical practice. These differences are mainly examined in the light of the controversial dominance of Hegel's concept of logic (and theory of concept) in twentieth-century continental philosophy. The inquiry is developed in two parts. In the first (Sections 1-2), I indicate some aspects of the analytic-continental divide, pointing to the role that the topic 'logic and philosophy' plays in it. In the (...) second part (Sections 3-6), I give a short account of the views of logic which are typical of the three main trends of continental philosophy (see Table 1). I also suggest how, with the aid of some typical analytical devices, some continental 'anti-logical' attitudes may be corrected, on their own terms. (shrink)

We investigate whether ordinary quantification over objects is an extensional phenomenon, or rather creates non-extensional contexts; each claim having been propounded by prominent philosophers. It turns out that the question only makes sense relative to a background theory of syntax and semantics (here called a grammar) that goes well beyond the inductive definition of formulas and the recursive definition of satisfaction. Two schemas for building quantificational grammars are developed, one that invariably constructs extensional grammars (in which quantification, in particular, thus (...) behaves extensionally) and another that only generates non-extensional grammars (and in which quantification is responsible for the failure of extensionality). We then ask whether there are reasons to favor one of these grammar schemas over the other, and examine an argument according to which the proper formalization of deictic utterances requires adoption of non-extensional grammars. In his newly updated version of The Anatomy of a Constitutional Law Case, Alan F. Westin provides a documentary portrait of historically important constitutional law case, 'Youngstown Sheet & Tube Co. v. Sawyer, ' from its rise in a bargaining dispute in the steel industry during 1952 to the aftermath of its decision by the United States Supreme Court. Westin has added to his classic book additional materials and personal commentaries collected since the work was first published. The new information (...) covers what went on within the Truman administration, what went on within the Supreme Court when analyzing and resolving issues that come before it. Westin includes selections from transcripts, briefs and other official proceedings, adds notes describing each phase of the constitutional process, and a section of commentary and questions relating this case to others.
